Această lege a salarizării unice lichidează puterea judecătorească … Nu mai suntem demnitari, în situaţia să judece demnitari, suntem asimilaţi cu aparatul administrativ din alte ministere.

P.S. Despre această lege nemernică am mai scris şi voi reveni. Doamna Pivniceru este până acum singura persoană care a sesizat un mare viciu de fond al acestei calamităţi de proiect, pentru care premierul Boc vrea să angajeze răspunderea Guvernului. Sindicatele parcă sunt drogate.

    sindicatele??? dar oare cei care s-au cocotat(majoritatea) in functii de lideri neschimbati de decenii?? dar afacerile lor cu clasa politica?? cati dintre ei au ajuns in parlament si guvern?? si apoi mai sunt cateva sectoare din societate care sa mai conteze cand stau in spatele sindicalistilor..in rest?
    nu doar cu legea asta idioata se incearca lichidarea justitiei mai sunt si alte actiuni gen descinderea SRI, propunerea de venire in randul procurorilor a unor functionari din politie si tot asa

    Doamna vrea bani pentru magistrati, ce noutate. Dar despre pensiile speciale sau despre salariile actuale, nimicuta, nimicuta. E greu mersul inapoi pentru magistrati. Sa mearga prostimea inapoi ca ei stiu si drumul asta!

    Ce sa mai zica medicii care au un salariu, potrivit noilor prevederi, in medie, de cca 3 ori mai mic decat al judecatorilor. Chiar daca ar vrea sa zica si ei ceva, tot nu i-ar auzi nimeni, din cauza acestei moldovence insuportabile cu o gura cat intima sinistrei en vogue. Priviti-o cu atentie, cu masca de gaze pe figura (ca sa nu va dea jos vaporii de etanol emanati, pe langa ea, Dan Iosif parea un ingeras) si concentrati-va putin asupra chipului ei senin. Se vede ca isi petrece serile lungi de iarna in biblioteca universitatii de drept, studiind pentru binele magistratilor. Aceasta e „doamna” care sare imediat in apararea oricarui „magistrat” punandu-ne aceeasi placa uzata, vezi doamne, nu intelegem noi muritorii de rand cum devine treaba cu prezumtia. Fie ca e vorba de betivana aia prinsa in trafic manga sau de alta judice care a aranjat cu gunoierul urbei sa dea teapa la CASCO (cucoana isi lovise masina da’ deh, ea era magistrat). Daca ar fi cine stie ce cavaleri ai dreptatii intr-o societatate corupta ca a noastra, i-as intelege. Dar sunt, aproape toti, numai betivi, spagari si curve. In plus, sunt responsabili, si ei, pentru dezastrul economic si moral pe care il traim.

    nici Justitia, exoticul modelul romanesc, nu este mai breaza. Multe dintre necazurile romanului isi au sorgintea in modul cum inteleg, de 20 de ani incoace, magistratii, procurorii, avocatii, adesea in „buna intelegere” cu celelalte puteri ale statului, sa presteze in spiritul si litera actului de justitie. Stiu, sunt si exceptii. 😦

    PROFESORI, DOCTORI, FUNCTIONARI,MINERI,CFR-ISTI SI ULTIMII PE LISTA MAGISTRATII.

    Astia chiar TREBUIE terminati…..ASTIA SUNT PERICULOSI .. ei chiar au painea si cutitul si POT aplica legea… ei chiar pot aduna ( daca vor ) pe toti cei care au furat si fura si ….Nu sunt putini..

    Se pare ca tot ce au atins GUVERNANTII … au terminat , ars , pustiit..

    Greseala si minciuna este ca NU toti MAGISTRATII ( sunt vrea 6000 ) in tara .. au salariile lui Morar sau Kovesi…

    nu conteaza ca aceasta casta a magistratilor are fond de salariu zecimi de fractiuni din pib,individual ei ajung la venituri si pensii > 3oo milioane /luna, ceeace este imoral fata de milioane de alti salariati sau pensionari, care au venituri modeste. ingineri,profesori,economisti,sa, cu aceeasi pregatire universitara si vechime, care inainte de „89 aveau venituri similare cu magistratii, acum au salarii(si pensii) maxime de 10-15mil/luna.unde este echitatea? ce inginerii n-au raspundere,chiar cad la datorie: vezi accidentul de la petrila,otelul rosu,sa.profii, la fel raspund penal pt copii,samd.puteti sa comparati 350 mil ale magistratilor cu cele 10-15 milioane, ale celorlalti?ce conteaza, pt.ei,pe timp de criza, plata a 300 mil €(eur) sporuri calculate mincinos de 2 ori retroactiv(1,5×50%=75%) pe 5 ani pt o parte de magistrati,ca altii i-au luat deja?daca magistratii nu si-au ridicat salariul de pe card,fara acest spor aberant(stress),inseamna ca nu stau in salariu-au bani!alte categorii de personal,in conditii de criza, nu si-ar putea permite asa ceva.i-ar ridica! in plus,li se deconteaza numai chirie 600 €(eur)/luna, alte bonusuri: prime de vacanta,al 13 lea salar,sa,sa.

    Bre vedeti ca plescoita iar a avut astazi de-a face cu organu’ si cu organe. Bref cu organu’ Salvamar si membrii sai, carora, intr-un concurs suigeneris, dupa ce s-a antrenat la oral cu fluieru’, le-a masurat organele vizibile prin slip 🙂 🙂 🙂 . Pe asta daca n-o opreste nimeni, in curand o depaseste pe austriaca medievala si va inspecta fondul „turistic” masculin cabalin, doar, doar si-o gasi un armasar pe masura.

    Aceasta doamna cu figura de rusoaica si nume predestinat pentru condamnatii la „pivnita grea” si-a cam pierdut credibilitatea cand a aparat-o, sfidand presa si opinia publica, pe judecatoreasa olteanca eliberatoare pe banda de recidivisti periculosi..
    Se plang judecatorii ca judeca zeci si sute de dosare intr-o singura sedinta.
    De ce nu spun si in cate sedinte pe luna judeca si ca aceleasi dosare le judeca luni si ani de zile.
    Salariile lor sunt peste puterea bugetara a statului roman iar pensiile lor speciale, ca si ale parlamentarilor, nu sunt calculate dupa principiile solidaritatii sociale si contributivitatii la Fondul de Pensii, principii care guverneaza sistemul public de pensii.

    Problema ţine nu de persoane sau neapărat de aspectul material. Mă tem că majoritatea nu aţi sesizat esenţa şi asta explică halul în care suntem ca popor, de fapt, populaţie din care se poate face orice, uşor de dezbinat şi de manipulat, prin obsesia caprei vecinului şi pasiunea pentru derizoriu.

    @Franklin. Mă tem că nici tu n-ai înţeles. Şi e nedemn în general şi în particular pentru nivelul tău de înţelegere să abordezi problema atât de brutal visceral. N-am apucat să verific ID-ul, mă întreb dacă eşti chiar tu.

    @Dinu. Justiţia a funcţionat foarte bine în România, până în momentul Ilici-Satu Mare şi recursuri în anulare. Din acel moment, s-a intervenit brutal în treburile justiţiei, s-a făcut denegare de dreptate de la nivel de şef de stat – ca şi acum, cu Băsescu, când le-a negat magistraţilor dreptul de a se adresa justiţiei, de parcă trebuia să-i judece tribunalul prezidenţial, magistraţii au fost timoraţi şi totuşi, majoritatea şi-au făcut datoria. Nu confunda cu etajul inferior al sistemului judiciar, respectiv, poliţia şi parchetul. Acolo e buba.

    @olimpiu. Da, sunt cam aceiaşi în vârful sindicatelor. Cei mai noi, ca Nistor sau Marica – principalii responsabili pentru propaganda anti-PNL – cel puţin şi-au făcut mea culpa foarte repede.

    @Roxana: nu d’aia nu merge justitia in Romania, Plano are si el dreptate intr-un fel, dar independetnta justitiei s-a terminat odata cu numirea procurorilor pe de-o parte, iar pe de alta parte, sunt convins ca domnii judecatori, care fie vorba intre noi, au lefuri care sa le asigure independenta financiara necesara pentru a fi impartiali si sa dovedeasca competenta sunt primii care pun botu’ la mita, si inca la mita cu o gramada de zerouri. Asa ca nu-i mai plange ca nici competenta si nici impartialitatea nu stau la usa lor, pentru a-i da afara din casa. Fac si ei din Justitie ceea ce face chiombu’ din politica, dovada atatea procese pierdute de statul roman in strainatate. Cine suporta costurile acestor sentinte eronate date de acesti magistrati? Iti spun eu, bugetul si nicidecum ei, chit ca si-au dat sentinte cu care isi maresc singuri salariile cu 50%.

In the eyes of the traditionalist wing of the Church, however, Kennedy should have been asking the Pope for forgiveness. The Vatican’s official newspaper L’Osservatore Romano reported Kennedy’s death, praising his work on civil rights and fighting poverty, but noted that his record was marred by his stance on abortion. As of yet, unlike some other world leaders, Pope Benedict has not commented or issued an official communique in response to Kennedy’s death. One veteran official at the Vatican, of U.S. nationality, expressed the view of many conservatives about the Kennedy clan’s rapport with the Catholic Church: „Why would he even write a letter to the Pope? The Kennedys have always been defiantly in opposition to the Roman Catholic magisterium.” Magisterium is the formal expression for the authority of Church teaching.     „He is a complicated figure,” says Rev. James Martin, a Jesuit priest and the culture editor of the Catholic magazine America. „Catholics on the right are critical because of his stance on abortion.     In what may mark the final flicker of Kennedy influence in American Catholicism, reports circulated last spring that Obama was considering JFK’s daughter, Caroline Kennedy, as the possible next U.S. Ambassador to the Vatican. That was not to be. Indeed in the wake of Uncle Ted’s death came word Thursday that Obama’s final choice had arrived in Rome to take up the diplomatic post at the Holy See.     Ce-mi aud urechile, ce „apostrofari”, intr-un limbaj de medicinist din anul IV -doar suntem amici :)- primesc de la ei atunci cand indraznesc sa le calc teritoriul cu intrebari de novice ori mirat-revoltat de cum vad ei -intre ei- actul justitiei, ma revolt suprem „civic”. …doar ma revolt civic ! …iar ei: „vezi-ti de treaba ta si cotizeaza la buget daca nu vrei sa fii devalizat cu ajutorul nostru.” 🙂
    Este momentul cand, jignit in demnitatea mea de contribuabil onest, ii poftesc afara de pe mosia mea, iar ei, firi sensibile altfel, se aseaza mai bine care pe unde are „treaba”, neuitand sa-mi spuna ca ambianta este singura care-i determina sa nu de-a curs, cum firesc ar fi, invitatiei mele imperative. 🙂

    Care o fi legatura intre barbosi si problemele „sindicale” ale judecatorilor? Poate d-na Pivniceru care ti-a smucit tie neuronii de plangi pe la morminte straine.
    Tie nu ti s-a luat sa-mi pui aceeasi placa ideologica in loc de argumente?
    Am discutat strict profesional despre activitatea magistratilor. Nici ei nu sunt mai presus de lege!

    A si am uitat de celebrele alegeri.. cind trebuie sa stea la sectiile de votare.

    Daca este asa de usor sa fii magistrat de ce Nu se fac toti magistrati ???
    Sa se desfiinteze ministerul lui Udrea si a lui Placinta si sunt bani si pentru porfesori si pentru magistrati…

    In what may mark the final flicker of Kennedy influence in American Catholicism, reports circulated last spring that Obama was considering JFK’s daughter Caroline Kennedy as the possible next U.S. Ambassador to the Vatican. That was not to be. Indeed, in the wake of Uncle Ted’s death came word Thursday that Obama’s final choice had arrived in Rome to take up the diplomatic post at the Holy See.     There was a poignant footnote to President Obama’s historic July 10 meeting with Pope Benedict XVI at the Vatican. Behind closed doors in the papal library, Obama handed Benedict a letter that Senator Edward Kennedy had asked him to personally deliver to the Pontiff. White House spokesman Robert Gibbs later told reporters that nobody — not even the President — knew the contents of the sealed missive. Obama asked Benedict to pray for Kennedy and called the ailing Senator afterward to fill him in on his encounter with the 82-year-old Pope.
    The letter, most likely already resealed and tucked away in the Vatican archives, was probably just a dying Catholic’s request for a papal blessing. In the eyes of the traditionalist wing of the Church, however, Kennedy should have been asking the Pope for forgiveness. The Vatican’s official newspaper L’Osservatore Romano reported Kennedy’s death, praising his work on civil rights and fighting poverty, but noted that his record was marred by his stance on abortion. As of yet, unlike some other world leaders, Pope Benedict has not commented or issued an official communiqué in response to Kennedy’s death. The niceties of international diplomacy do not require the Pope to issue a statement on the death of a non-head of state. Earlier in August, when the Senator’s sister Eunice was dying the Papal Nuncio to the U.S. delivered a letter to her and her family saying the Pope was praying for her, her children and her husband.

    One veteran official at the Vatican, of U.S. nationality, expressed the view of many conservatives about the Kennedy clan’s rapport with the Catholic Church: „Why would he even write a letter to the Pope?     In loc de generalizari va propun un remember al cazului Gorbunov. E atat de reprezentativ pentru justitia romana, pentru guvern si pentru presa, incat chiar merita sa reflectam putin asupra sa.

    Un criminal binecunoscut in bransa, pe numele lui Serghei Gprbunov, e eliberat din penitenciar de o JUDECATOARE din Craiova, din motive medicale. Dupa cum se stie, ceva mai tarziu, omul juca fotbal cu politia la sala de sport la momentul „T” deci e de presupus ca era, de fapt, sanatos tun. Cum a fost posibil? Cei mai multi spun ca era informator al politiei, ca asa sunt regulile nescrise in Uground, etc. OK, deocamdata.

    O crima oribila prin circumstantele infaptuirii ei (a fost ucis un om curajos, tocmai pentru aceasta calitate, dac ar fi fost las ar fi trait, se intampla des), intens mediatizata, a fost comisa la o casa de schimb valutar din Brasov. Faptasii reusesc sa fuga.

    Imediat apare la mai toate posturile de televiziune un portret robot al presupusului criminal care seamana izbitor cu cel care, cateva zile mai tarziu avea sa ne fie prezentat ca suspect principal, Serghei Gorbunov. Incredibil, cineva din politie, evident un expert, a prelucrat fotografia lui Gorbunov si ne-a „livrat-o” ca pe un portret robot. Cum a fost posibila o astfel de manipulare. La 14 ani, as fi avut suficient discernamant sa nu indraznesc sa fac asa ceva. Ce fel de oameni sunt in politia romana?

    Ca prin minume, in prima duminica de dupa comiterea crimei, ministrul de interne de o zi, unul Dragnea, din Deliorman si el ca si Videanu, ne abureste ca politia e pe urmele suspectului, ca politia face si drege dar ca nu poate spune deocamdata mai multe. Profesionisti, mi-am spus atunci.

    Gorbunov e arestat curand si opinia publica constata ca „portretul robot” a fost corect intocmit, chiar semana cu „faptuitorul”. Dar, stupoare, suspectul are un alibi imbatabil, era cu mai multi politisti la fitness. E totusi inhatat si cercetat pe toate fetele si in final reincarcerat.

    Saptamana trecuta, Gorbunov a protestat din arest, spunand ca este rau tratat si ca i se incalca drepturile omului. Citind stirea la radio Magic FM un prostovan de crainic isi depaseste autoritatea si isi iese din rol adresandu-i-se direct lui Gorbunov, „Pai bine ma criminalule, ce drepturi mai vrei dupa ce ai facut…”. Cum e posibil asa ceva avand in vedere ca, fata de speta in cauza (cum ar zice d-na Pivniceru) omul e, dupa cate se pare, nevinovat. Ce justitie mai e si asta?

    Sa presupunem acum ca SG a fost eliberat din penitenciarul Craiova in calitate de informator al politiei, pentru a servi acestui scop. Aproape ca am intelege dar atunci, de ce i s-a mai inscenat mascarada cu portretul robot? Pentru ca sa dea bine la public ca politia e eficienta? Sau ca sa acopere adevaratul/adevaratii criminali? In ambele variante, ma cutremur de indignare, de teama si scarba. Cum e posibil asa ceva intr-un stat european? Cum poate contribuabilul plati, din munca lui, astfel de politisti, procurori si ministri de interne?

    Adevaratii asasini nu au fost inca identificati. Presa tace malc asupra afacerii. Cum tace si in cazul Ciorogarla, readus oarecum in actualitate de afacerea Mircea Basescu. Si aici, niste tineri (paznici) stau in inchisoare intr-o afacere in care nici hotii si nici armele nu sunt de gasit. Ce justitie mai e si asta? Ma intreb ce le-ar fi facut bietilor oameni daca i-ar fi ciuruit pe „hoti”. Cine stie ce surprize am fi avut!

    In concluzie, eu unul nu stiu daca guvernul va lichida justitia dar stiu sigur ca daca lucrurile vor continua, guvernul + justitia ne vor termina pe noi.

    @Marcus. Scuză-mă. dar faci confuzia obişnuită între justiţie şi sistemul judiciar (dacă citeai un răspuns al meu anterior, am precizat şi acolo). Nu ştiu cine te-a convins că judecătorii, puterea supremă a ţării, au salarii „suficiente”, în condiţiile volumului de lucru, a consumului pe care îl implică profesia şi a interdicţiei de a avea o activitate lucrativă paralelă. În ce priveşte „corupţia”, faci afirmaţii fără acoperire. Poate dai şi exemple de sentinţe eronate. Dar ai intra pe un teritoriu delicat, cel al restituţiei. În marea majoritate a cazurilor, judecătorii şi-au făcut datoria. Foarte puţini au greşit şi asta ne costă la CEDO. Dar nu-i corect să faci din excepţie, regulă şi invers. Nu ţi-ar plăcea să-ţi amintesc faptul că toate astea se trag de la indicaţiile preţioase ale lui Ilici, de unde recursul în anulare asupra multor hotărâri judecătoreşti drepte. Cât priveşte ultima afirmaţie, în care – ai să te superi din nou, dar asta e realitatea – te pupi cu Băsescu în opinie, cine să le fi făcut dreptate? Tribunalul poporului? Şi NU şi-au dat în plus, aşa cum spui tu, ci şi-au recuperat ceea ce LI S-A LUAT, pentru ca Pogea să-i dea Duduii.

SISTEMUL JUDICIAR ESTE FORMAT DIN POLIŢIE, PARCHET (PROCURATURĂ) ŞI JUSTIŢIE. Justiţia este NUMAI acolo unde este INSTANŢA.

    Daca intrebi 10 000 de trecatori de pe strada, cine este vinovat pentru afacerea FNI, ei bine, ABSOLUT TOTI, adica exact 100%, vor raspunde Sorin Ovidiu Vantu. Si eu as fi printre ei, cu siguranta si voi. SOV a prabusit fondul cu buna stiinta si si-a insusit banii, ca un mega-escroc ce se spune ca e.

    Justitia romana nu-l considera, insa, vinovat pe SOV, cel putin deocamdata. Rezultatul e ca toata lumea e frustrata, SOV isi freaca mainile bucuros si face jocurile in media si in politica.

    Ce este de fapt justitia?
    Pentru mine justitia ar trebui sa fie o institutie care sa-l bage pe SOV la mititica, nevinovat, sacrificandu-l pentru cele 20 de milioane de romani.
    Pentru d-na Pivniceru, justitia e institutia care il lasa pe SOV in liberate desi STIE ca e vinovat, doar pentru ca nu i se poate dovedi vinovatia cu suficienta certitudine in instanta, spre disperarea celor 20 de milioane de romani.

    Monica…M se poate lauda ca a reusit sa creeze o casta de magistrati…privilegiati… care se simt demnitari numai daca au salariul dublu fata de un ministru.

    Cazul Gorbunov e relevant pentru intreg sistemul judiciar, dupa cum spui, politie, parchet si instante (nu uita ca multi infractori periculosi sunt eliberati), de aia l-am si reamintit. E off topic la Mona Pivniceru. Bineinteles ca in „sistemul judiciar”, judecatorii sunt, sa zicem, speranta noastra in actul de justitie. Dar de la sperante la realizari mai e cale lunga de strabatut.

    @Roxana, la nivelul de trai din Romania, magistratii nostri au salarii mai mult decat indestulatoare, tocmai pentru a-si face meseria cu profesionalism si departe de ispita mitei, lucru care mi se pare firesc. Nefiresc (si-mi vine sa ma omor ca am aceeasi parere cu chiombu’) mi se pare metoda aleasa de a-si atribui in justitie sporul de 50%. Ei sunt putere in stat, nu stat in stat. Vad ca tu rezumi tot actul de justitie la restituirea proprietatilor. Am mai vorbit despre asta si stii ca parerea mea (aici o comit din nou!) de data asta coincide cu a lui Iliescu, nu indrepti o nedreptate comitand alta si mai mare, mai ales cand sistemul a permis cumpararea dreptului de proprietate aflat in litigiu, facand astfel din unii milionari in dolari, fara niciun merit, decat legaturile de tip mafiot stabilite cu judecatorii, iar pe altii lasandu-i fara acoperis deasupra capului, dupa ce o viata au platit chirie si au mentinut fostele proprietati in viata prin proprii bani investiti in intretinerea lor. Exemple vrei? Sper ca n-ai vorbit serios ! Insa pe linga retrocedari Justitia romana, mai judeca si multe alte spete in care numai impartiala nu se arata a fi, asa ca…

    „Adunarea Generală a judecătorilor de la Curtea de Apel Bucureşti a decis, vineri, ca, de la 1 septembrie, să îşi restrângă la minumum activitatea, să nu mai facă parte din birourile electorale, iar procesele vor primi termene direct în 2010.
    Adunarea Generală, care îi reprezintă şi pe magistraţii din judecătoriile de sector şi Tribunal, a hotărât mai multe forme de protest, care vor începe, de la 1 septembrie, cu judecarea numai a cauzelor penale privind starea de arest. Restul dosarelor vor fi amânate pentru 2010. De asemenea, magistraţii nu vor face parte din birourile electorale. Ei nu vor judeca nici contestaţiile electorale.

    În cadrul aceleiaşi întâlniri, magistraţii au stabilit că nu vor mai accepta să judece aşa de multe dosare, chiar şi după terminarea protestelor. Astfel, fiecare instanţă ar urma să stabilească numărul cauzelor care vor intra rol în fiecare şedinţă.

    Tot pentru perioada de după protestele anunţate pentru 1 septembrie, judecătorii au decis să încheie şedinţele de judecată la ora 14.30, ca până la 16.00 să poată delibera şi astfel programul lor de muncă să nu depăşească opt ore.

    Începând cu data de 1 septembrie, personalul auxiliar va refuza orice activitate cu publicul.”
