Salutări invitaţilor, Maria Teodoru şi Marius Murgu, militanţi pentru restituţie.
Poate, totuşi, vreun liberal va sesiza Curtea Constituţională cu privire la caracterul anticonstituţional al acestei legi, încă nepromulgate.

Emisiunea a scos in evidenta un singur lucru,acela ca niciun invitat nu cunostea legea ce va urma sa apara.Toti isi dadeau cu presupusul si faceau scenarii cu “ce s-ar putea sa se intample” in frunte cu Maria Teodoru.
Iar blonda din poza nu facea decat sa starneasca rasul,ca de obicei

@Periscop. Bun venit, oricum! O lege care încalcă un principiu de drept şi constituţional fundamental, dreptul la proprietate, nu poate fi decât criminală. Poate că dumneavoastră nu sunteţi chiar atât de avizat pe cât vă amuzaţi să credeţi.

Pai exact asta apara doamna,dreptul la proprietate.Ii protejeaza pe cei care au cumparat de la Stat impotriva baietilor destepti ai retrocedarilor pe ultima suta de metri.E adevarat ca cei care si-au revendicat din timp casele confiscate ar putea sa intre sub incidenta acestei legi dar imi mentin parerea ca nu stim forma finala a ei cu toate reglementarile.

@Periscop. Nu au cumpărat de la stat, au cumpărat case de furat, ştiind că sunt bunuri furate. Când foloseşti un bun furat intri sub incidenţă penală. Această lege e nu doar anticonstituţională, ci şi penală, domnule. Mafia retrocedărilor a proliferat tot în complicitate cu vechii hoţi perpetuaţi din vechiul aparat, toate eşaloanele. Mulţumesc pentru nivelul dialogului, în limitele civilităţii.

Doamna,eu cunosc f multi proprietari deposedati in comunism fara titlu asa cum sint majoritatea dintre ei.Pana in 1996 ei deja aveau deschise procese in instanta,au notificat atat ICRAL-ul(Statul) cat si pe chiriasii imobilelor aducandu-le la cunostinta faptul ca imobilul este in litigiu.Nu trebuia sa ai o hotarare judecatoreasca,trebuia doar sa ai deschisa o actiune in instanta.
Daca acele case aflate in litigiu fac obiectul de azi al acestei noi legi atunci dvs aveti dreptate,chiriasii stiau de statutul juridic al imobilelor.Dar sint multi care s-au trezit in acesti ultimi 2-3 ani cu tot felul de indivizi care chipurile au preluat drepturile litigioase de la proprietar,imobilul nefiind revendicat in termenul Legii tocmai pentru ca nu mai avea cine sa-l revendice sau nu mai avea temei sa-l revendice.Legea ar trebui sa expliciteze aceste situatii iar oamenii care s-au incadrat in toate termenele legale sa beneficieze de posibilitatea intrarii in posesie a imobilelor dar acolo unde chiriasii au cumparat chiar de buna credinta imobilul nefiind revendicat in termenele prevazute de lege(10) acolo ei sa fie cei protejati.

@Periscop. Logica dumneavoastră nu este foarte aproape de perfecţiune, pentru că dumneavoastră aprobaţi o lege injustă şi neconstituţională – împotriva dreptului la proprietate , pe motiv că de restituirea proprietăţii beneficiază o mafie. Repet: mafia este emanaţia sistemului care i-a furat pe proprietarii de drept. Chiar nu vă daţi seama ce aberaţie susţineţi? Adică, oameni care se luptă de 17 ani ca să-şi recupereze proprietăţile – şi sunt încă foarte mulţi, sute de mii – sunt privaţi de dreptul lor constituţional la recuperarea proprietăţilor furate, doar pentru că o mână de profitori li se substituie în anumite situaţii. De fapt, e doar un pretext, iar mafia PSD-PC-PD-L a intenţionat să dea o lovitură electorală prin fariseica protecţie a chiriaşilor. De fapt, se protejează nişte nelegiuţi care ar urma să poată cumpăra proprietatea furată a oamenilor. Şi chiriaşii care cumpără o proprietate furată sunt la fel de blamabili ca şi mafioţii revendicărilor ilegitime.
Încă un lucru: nu prea există imobile nerevendicate.

La cutremurul din San Francisco din 1905 ( care este redat si in pelicula faimosului film “San Francisco” avand in rolurile principale pe Clark Gable si Jeannette McDonald despre un oras in care locuitorii sai comit tot felul de nelegiuiri de la mic la mare) intr-adevar s-a deschis un crater adanc de cateva zeci de metri, iar dupa cateva minute cand un aftershock a zguduit din nou orasul, craterul s-a inchis la loc ingropand de vii multi oameni! Dear Sir
The American Romanian Professional Artists’ Association has joined the Committee for Private Property to protest the unmerited honor granted to the Romanian Pres. Emil Constantinescu by ABA/CEELI.
All of us in the Romanian community here in America are astonished at the lack of information which you have demonstrated to possess, and downright dismayed at the superficiality and lack of discernment that has led you to take such an erroneous decision to accord the ABA/CEELI Award to someone who condones and further assists in the perpetration of injustice in his own country together with the Red Mafia and his cronies to whom he caters! We would like to take the opportunity to inform you that Pres. We all know that Emil Constantinescu was a former Communist Party Secretary at the University of Bucharest; therefore, he has never been a dissident as it is so falsely stated in his biography. For about three years while in office, he has neglected to keep his promise of authentic economic and political reforms to the great majority of us who had elected him in order to pass these democratic reforms that would have otherwise ridden our nation of the dreadful plagues of the Gorbaciovist Perestroika (the 50% Communism, although the free democracies of the world would never accept any of it however minute!) which symbolizes death camouflaged by a humane face, and which is just as destructive as the 100% of Communism! Such veridical democratic and economic reforms would have aided the nation to progress in all areas and have thus helped the nation become economically prosperous if only the people’s illegally confiscated belongings (homes, forests, agricultural lands, livestock, and machinery, all industrial and commercial means of production) would have been fully restored to their rightful owners, especially those homes and properties illegally confiscated by the Communists who still illegally possess, occupy, and profit from them. The Communists have also taken over to privately possess the industrial, commercial, banking and other various enterprises to which every citizen should have had equal access in the privatization process to bid in a fair manner in those so-called “public” auctions, which in fact have been rigged by corrupt government officials in order to make a profit for themselves as well as favor their Communist Red Mafia cronies and Pres. Constantinescu’s favorites.
Although he publicly claims to support Sen. Constantin Ticu Dumitrescu’s Law of Lustration to abolish all politically motivated sentences rendered in the past by the Fascist and Communist regimes that also carry measures to reinstate all rights to repossess the confiscated property, Pres. Constaninescu in reality does not support these measures. Although Pres. Constantinescu has absolved a minute number of Anti-Communist political prisoners, the number is still so insignificant compared to the overwhelming masses of citizens abused by the Communist and Neo-Communist regimes who are still waiting for justice. Also, the former Anti-Communist Political Prisoners as well as many Anti-Communist Freedom Fighters who have helped the USA and its other democratic allies to defeat the Communist Evil Empire of the Soviet Union, now Russia, are still condemned to death as well as life-term prison sentences — sentences which also carry expropriatory measures of homes and all property as well. For example, only as a direct result of great political and diplomatic pressure from the US government, and certainly not as a result of the Romanian Government change of heart was Gen. Ion Mihai Pacepa cleared recently of all false charges of espionage; and consequently, having all his property, his former military rank of General of the Romanian Army together with all his other rights fully restored. (For your information, Gen. Ion Mihai Pacepa — as well as Dipl. Ion Stana, Dipl. Mircea Raceanu, Gen. Odobescu who had saved NATO in the early ‘70’s, — had dealt a mortal blow to the Communist Empire by his defection to the West. Gen. Pacepa has previously advised all US presidents and our NATO allies in foreign policies concerning the Soviet Union and its satellite Communist allies therefore greatly aiding the free democratic nations in their fight to defeat the Evil Empire[1]). But the Romanian Supreme Court Decision has not vindicated Gen. Pacepa politically as it was expected! The verdict rendered in his case has absolved him only due to lack of evidence in his case and not to the truly political fact that as head of the Romanian foreign espionage he had simply refused to carry out Ceausescu’s as well as the KGB’s orders to murder innocent people abroad just because these people were opposing the Communist tyranny behind the Iron Curtain. For 25 years Ceausescu’s band of thugs and criminals have persistently pursued to murder him throughout the world. In order to further seek vengeance against Gen. Pacepa, by this kind of verdict, the Securists have allowed themselves a way of return for the time when they will back in power, so that they can concoct some “evidence” against Gen. Pacepa in order to destroy him. In this manner, they might claim the discovery of “new evidence” –- but in fact, fabricated, false evidence (as is the Securists’ well-known habit) — against him in order to demand Gen. Pacepa’s head whereas they can still accomplish their revenge by apprehending and killing him abroad. They had already threatened to do so in various media, whose voices also included those of Virgil Magurreanu and Gen. Nicolae Plesita, in the same manner as the KGB and Nicolae Ceausescu have previously ordered their gang of internationally-notorious criminals such as Carlos The Jackal (who is responsible for the explosion of Flight 800 over Lockeby which has caused the death of hundreds of innocent people; the terrorist explosion at Free Europe’s Munich Headquarters killing and maiming Americans and other innocent civilians working there; the attack against Free Europe’s reporter Monica Lovinescu in Paris; Dissident Paul Goma’s attempted assassination with the famous poisoned pen in Paris; other violent crimes in France and Switzerland committed by The Jackal at Ceausescu’s orders, etc.; the terrorist Abu Nidal,(both are now in French government’s custody), as well as Securitate officers such as Gen. Nicolae Plesita who coordinated Carlos’ terrorist actions[2]. Even now these notorious criminals are still continuing to enjoy their privileges as they are still residing in homes belonging to someone else, as well as they are still enjoying their big, fat pensions in freedom and prosperity instead of being condemned for their criminal acts, while the great majority of honest, hard working individuals are still living in terror and dire poverty!
The Romanian State has still a long way to go on the path toward establishing the Rule of Law! Even today, the Romanian State is still operated by the dreadful Communist ways of the past (as correspondence and phone calls are still intercepted and violated even as we speak) by the now ten(10) secret services! which once formed the entire Securitate apparatus of repression. The lack of action, delay tactics, ambiguous laws, unenforced existing laws, and interminable debates which had already sent out negative signals that the Romanian Government is acting in bad faith towards the great majority of its citizens thereby often causing them grave injustices while protecting the privileges of the few (Securitate officers and all the rest) in the Communist and Neo-Communist nomenclature. All these obstacles have given us no other forum for our grievances but to turn to our own American politicians, the US Government, and various organizations in order to support and defend our righteous cause. During Pres. Constantinescu’s three years tenure in office, our homes have been illegally sold to the present occupants in the former Communist nomenclature.
Then, one would normally ask the logical question: why was Emil Constantinescu elected President by the Romanians? The answer is the following: that the Romanians who truly wanted authentic democratic reforms have learned much later than the October 1996 General and Presidential Elections that in fact The Democratic Convention (CDR) has been greatly infiltrated by Securitate agents who have in fact deceived the Romanian electorate to be true democrats wanting a break from Communism, when in reality all they wanted was to maintain the Communist system with its privileges only for a few as in the disastrous example set by the defunct Soviet Union and further perpetuated at present by Russia’s autocracy (exemplified by the type of the present corrupt Russian oligarchy which has rendered its conationals to extreme poverty and famine while accumulating immense riches for themselves!) and its horrid Political Secret Police. This is the main reason the Romanians overwhelmingly want their country to join NATO, and through it, the big democracies of the world in order to rid ourselves of this devastating Russian influence forever!
…And President Emil Constantinescu is categorically opposed to and is covertly blocking (although in public he loudly declares his support for this measure) another crucial political reform measure that would further establish and strengthen the so much vulnerable and young Romanian democracy: namely Sen. Constantin Ticu Dumitrescu’s Law of Deconspiring Securitate (known as The Ticu Law, giving every citizen the right to inspect his Securitate files as well as making it mandatory for every government official and all political candidates running for elected office to allow the public to inspect their Securitate files) which is so necessary for the purpose of regaining the nation’s socio-politically “mental health” as symbolized by Ophelia in Shakespeare’s Hamlet –- the national equilibrium — by purging the Romanian government and nation of the disease and moral decay perpetrated by these Communist and Neo-Communist evil agents infiltrated in all aspects of Romanian socio-political life which have damaged the nation’s fiber throughout the 55 years of Communist and Neo-Communist tyranny. All the other former Communist countries have already adopted such deconspiration laws that have truly helped them clean up these nations thus freeing them and restoring them to normality; and finally make them achieve spectacular progress! If he has nothing to hyde, then why is Pres. Constantinescu so tacitly opposed to the Ticu Law to deconspire Securitate even to the point of obstructing it?
The truth is that in the past, the acting Romanian president has been the Communist Party Secretary at the University of Bucharest –- fact which was deliberately omitted from his biography – therefore, he has rather been a part of the Communist nomenclature, and certainly not a dissident. Above all else, because of not keeping his word to us but has rather acted contrary to the very democratic ideals he had promised to uphold and accomplish in front of the entire Romanian nation which has trusted him, the incumbent president not only that he has already lost his credit in our eyes, but above else, he has compromised the lofty democratic ideals of liberty and freedom which were so dearly embraced by our American founding fathers, George Washington, Thomas Jefferson, and Abraham Lincoln. By honoring Pres. Emil Constantinescu who condones injustice at the expense of his powerless and still suffering citizens, your prestigious organization lowers its standard and recognition.
On the other hand, Sen. Constantin Ticu Dumitrescu, (who has also been elected as the President of the International Anti-Communist Movement), has earned his position as the only uncontested and morally-justifiable leader of the Anti-Communist Movement CDR, and the most trusted guardian of its ideals, whose capable hands have sponsored the three most important laws symbolizing the quintessence of the Romanian Anti-Communist Revolution which have been enunciated in the 1989 Proclamation of Timisoara: known as The Ticu Law, The Law of Securitate Deconspiration allows not only the citizens’ right to their own Securitate files but also the public’s right of access to all Securitate files of all government officials and of the candidates seeking public office; The Law granting the Return of illegally-confiscated properties by the Communists and Neo-Communists to their rightful owners and their heirs; and the Law to abolish all politically-motivated sentences including all pending death and life sentences passed by the Communist and Neo-Communist regimes together with the return of confiscated properties to those politically-persecuted detainees who have fought to destroy Communism as well as to their heirs.
By his proven, dependable track record constantly providing steadfastness and courage in his actions, but most important, displaying always the moral uprightness as well as demonstrating the high standard of ethics characterizing his public and private conduct, Sen. Ticu Dumitrescu is an inspiration in leadership and the much sought-after quality of courage so desperately lacking to the Romanians at present (as opposed to the prevalent duplicity and cowardice) that even his fiercest enemies eventually come around to admire. It takes one of The Great Alexander’s heirs not to know the word “impossible” and to live by the motto: “I am too desperate to let myself be defeated!” even when facing the most impossible odds against him! On the same spiritual dimension like his ancestor Alexander The Great to whom he is linked through his mother’s heritage, (though in the physical plane on a much smaller scale), Ticu Dumitrescu proves to be the brave, most reliable leader who demonstrates great faith, perseverance, diligence and staying power under the fire of great insurmountable adversity thrown at him by his enemies; these enemies hit him with their best shot possible, only to be desperately confounded by the even greater magnitude of Ticu’s backlashes!; and again, like Alexander, he surpasses all expectations by always finding the right magical solutions which never fail to defeat these enemies, thus accomplishing everything he sets his mind to do. Petre Roman and the Trans-Securists in the Senate rendered the Ticu Law ineffective only to be confounded by Ticu’s even greater comeback in the political arena through his magnificent leadership feats which succeeded to mobilize the entire Romanian society against the Trans-Securists in the Romanian Legislature by coalizing all the authentic democratic forces in the country under his leadership. Thus, he achieved the triumphant reintroduction in Parliament of the original Ticu Law which the senator first introduced three years ago in the Senate; and finally challenging his enemy, Ion Diaconescu, not only to have the Senate reconsider their gaffe, but to have both the Senate and the Deputies’ Chamber restore and pass the original version of the Ticu Law sponsored by Sen. Ticu Dumitrescu.
Even though in such times as ours when on the international arena the high and mighty others abdicate from their sacred mission in the accomplishment of true democracy by Justice which promotes social harmony and peace — the legacy of Alexander the Great Macedonian’s Greek civilization and that of the American founding fathers and their illustrious predecessor Abraham Lincoln — as well as neglecting their duties of maintaining the peace and stability of the world by failing to provide the so much-needed leadership to bring peace, freedom, and liberty to the still-oppressed nations of the world, God has deemed to raise such a man which inherited only the smallest, tinny speck of Alexander’s awesome personality and heritage, who is linked (even though through his mother’s lineage) with the Greek-Macedonian heritage, in a small, (often considered by these high and mighty others) unimportant country, to accomplish His Mission of Justice in Romania. The idea of genuine democracy comprised in the legacy of the Greek Civilization manifesting its idealism in the mostly fulfilled ideals of the American Revolution through a truly democratic form of government based upon a strong and solid system of Law and Order, and above all, EQUAL JUSTICE FOR ALL UNDER THE LAW!, finds its most loyal advocate in Constantin Ticu Dumitrescu. Since no one in the world’s Contemporary History from a former Communist country like Romania (which is still coveted and entangled in Russia’s predating claws, who just won’t let go of us) has had to deal with (let alone succeed to overcome) the insurmountable challenges and adversity of bringing authentic democracy, justice, economic and social reform until Ticu Dumitrescu has risen to the great challenge to do so for Romania and even succeeding at it, thus ensuring for himself a place of prominence in Romania’s history. Perhaps, just like his celebrated ancestor Alexander the Great from Antiquity, as well as those great men in the history of mankind who had left to posterity a heritage of authentic democracy that fosters the ideals of freedom and justice, while at the same time permitting the evolution and further perpetuation of democracy to an even more elevated dimension of the authentic democratic form of government: in Modern History, such as George Washington, Benjamin Franklin, Thomas Paine, Thomas Jefferson, John Jay, Abraham Lincoln, James McKinely, Theodore Roosevelt, Ronald Reagan in America, and Iuliu Maniu, Pope John Paul II, Margaret Thatcher, Helmut Kohl, Vaclav Havel in Europe, there exists the possibility for Ticu Dumitrescu to enter even in the world’s history annals as a man defining his time, as a man of destiny.
In our opinion, Sen. Constantin Ticu Dumitrescu should have merited your organization’s considerations and top honors.

PS: One of my cases is as follows: my grandparents used to own a garden (which was left to me in their will and now belongs to me) in the village Sambata de Jos, Voila Commune, Brasov District, ROMANIA which they did not surround with a fence because since the garden has access to the river, they as well as the rest of the village people used it as a laundry space as well as for the preparation of wool and linen fibers which the women had always used in weaving linen cloth and beautiful folk-art national costumes, clothes and priceless interior decorations.
Although I have all documents (such as copies of grandparents’ and great-grandparents’ will together with the accompanying successive Successor Property Extracts from the Tribunal’s Title Deed Book — which have been updated every year due to my grandfather’s mayoral position which required him by law to disclose his income and property yearly, as such was the Order in the good old days of King Michael’s monarchy; how we wish it was so in today’s Romania; –, copies of the property’s title deed, no liens whatsoever on this property) that my garden truly belongs to me, the communist officials at the Voila Town Hall had simply given this land to a new coming, but very Communist as well as the village’s Securitate snitches, the Ion Nicula Family. First, this family has built a house on my garden. Twenty years later, they have taken over the entire garden by surrounding it with a fence, thus denying access to all the people in the village that would have needed to use the river facilities to process their wool and linen fibers as well as wash their laundry. But above all else, the Nicula Family’s selfish deeds have caused great hardship to the entire village population which found themselves having to go around for approx. five miles in order to have access to the river! Although in numerous times I’ve gone to the Voila Town Hall and have discussed my case with the mayor, nothing can be done now to recuperate my property because the present Romanian legislation does not allow the mayor to give me back my garden. Right now, I find it a total waste of my money to spend unnecessarily on lawyers just for postponing such a case as mine in the Romanian Courts due to lack of appropriate legislature.

@Felicia Mandrea. Mulţumesc pentru informare. Textul conţine, însă, inadvertenţe, şi preşedintele Constantinescu nu avea nici atribuţii executive şi nici legislative privind restituirea proprietăţilor.

Roxana, the point is that Constantinescu was bragging in the USA how nice and dandy the reforms were going during his tenure in office, when in fact it was not so; the greatest majority of rightful owners were still waiting, like today, to receive their confiscated or stolen properties from the state.

@Roxana: La acel timp, cei de la “LUMEA LIBERA” m-au informat ca, cu toate ca Presedintele Romaniei nu detine puteri executive, are totusi parghii care sa verifice daca legile sunt executate corect, lucru pe care Emil Constantinescu nu l-a facut. Astfel s-a ajuns ca securistii sa jefuiasca economia tarii, sa le preia abuziv proprietatile oamenilor in liniste si sa obtina si mai multa putere economica. De acord cu cei ce zic ca abrambureala asta constitutionala — adica aceasta mare incurcatura in delimitarea puterilor in stat — incurca bunul mers al statului. SI TOTUSI, LA ACEA VREME CAND PRIM MINISTRUL ERA DIN CDR SI PRES. CONSTANTINECU AVEA TOTUSI O MARE INFLUENTA ASUPRA OFICIALILOR DIN GUVERN, DECE NU AU RETROCEDAT PROPRIETATILE? Tocmai si pentru motivul acesta au dzamagit electoratul, care a refuzat sa mai voteze cu cei din Conventie; DE FAPT, AU DOVEDIT CA NU AU VOINTA POLITICA SA IMPLEMENTEZE REFORMA ANTI-comunista!

@Cei invocaţi v-au dezinformat. Preşedintele nu are pârghii în acest sens.
Uitaţi că în acel Guvern a fost şi PD, care a blocat tot. Greşeala cui i-a permis.

Eu inteleg perfect cum merg lucrurile in Romania…la fel si cei care au plecat si inca mai pleaca de scarba. De vina e transsecuritatea care, din pacate a sugrumat din fasa adevarata democratie in Romania. Ce aveti acum este doar forma deoarece niciodata nu ati avut continutul; iar voi va amagiti cu forma. Mai precis, aveti numai staniolul ciocolatei, dar nu nu si continutul, adica ciocolata in sine. Mai rau, credeti ca staniolul poate sa ia locul ciocolatei!
